Terms of Service
1. General Terms
These Terms of Service (“Terms”) govern your access to and use of our digital art services.By placing an order, you agree to be bound by these Terms and confirm that you are at least 18 years old or have parental/guardian consent.2. Commission Process
-Commissions are accepted through [DM on X, Bluesky and Discord platform].ROUGH SKETCH RULE-I will provide 1 or 2 rough sketches in early stages, If client approve the rough sketch they should pay the 50% down payment before I continue with the drawing and if client don't wish to continue with the commission they don't need to pay for the rough sketches.
-However, Client's are not allowed to use the rough sketch's either for personal or commercial usage.-If a client saw the the rough sketches already and I don’t receive a response within an hour of sending the rough sketches, I will delete the rough sketches photos that has been sent from the chat thread.This part if the TOS only applies if I stopped a potential commission due to difficulty with the client:
- The 1st initial Rough sketch is only part of commission process that requires no payment while the rest of each revision will require a payment if ever I stopped the commission due to difficulty with the client. This is to compensate my time and effort spent in those rough sketches ($3 per version of rough sketch).What do I mean by "difficulty with the client"?
-While I always prioritize bringing your vision to life and making sure you're happy with the final piece, there are situations where constant revision requests can become a challenge. If the revisions reach a point where the rough sketches no longer reflect my art style, or if the sketch already matches the provided references but concerns are repeatedly raised over small or unclear details, I may have to stop the commission.-All requests must include clear references and a detailed/Short description of the desired artwork.-I reserve the right to decline any commission for any reason.-I will send updates from Rough Sketch to Final Output Stage.-All updates throughout the commission process the will be in low quality and have watermarks.-After the full payment is done, I will send the high quality version of the final output.3. Payment
- 50% Down payment is required upfront once rough sketch is delivered and Approved.- Remaining unpaid balance must be sent to me(the artist) before I provide the finished artwork.Accepted payment methods: [Paypal, Gcash].-Prices are listed in [Dollars]-Strictly No refunds will be given once down payment and Full payment is done, unless I cannot complete the commission.4. Revisions
-Client are entitled to [3] revisions.-Revisions are only allowed during Rough to Flat Color stage.-Major Revisions are only allowed in rough sketch part while the rest of the commission process, Minor revisions are only allowed.-Major revisions after final rendering may incur additional fees.-Changes requested due to vague or missing references in the original request may also incur extra charges.5. Delivery
-Turnaround time varies by commission type and workload, typically between [3 days to 1 week].-You will receive the final artwork in [JPG/PNG format] via email or google drive link.-No physical product will be shipped.6. Usage Rights
-You must credit me when sharing online (Art by [@kiwibells_]).Artist’s Rights:
-I retain the rights to the artwork, including displaying it in my portfolio and on social media.-I will not use commissioned works for resale or merchandise unless it was a commercial contract.7. Prohibited Uses
You are not to:-Remove or alter my signature/watermark.-Claim the artwork as your own.-Use the artwork for AI training, NFTs, or blockchain technology.-Commission or share artwork that includes hate speech, extreme violence, or illegal content.8. Cancellation and Refund Policy
-You may only cancel a commission during rough sketch stage.-If I cancel the commission for any reason, I will also refund you, but PayPal fees will still be deducted from the total amount.-No refunds will be issued after the final piece has been delivered.9. Liability Disclaimer
-I am not responsible for any loss or damage that may result from the use or misuse of the artwork.-All services are provided "as is" without warranties of any kind.10. Changes to Terms
-These Terms may be updated at any time. Continued use of my services after changes means you accept the new terms.

Use the artwork to promote a monetized brand, stream, or business.Sell, edit, or distribute it in any way.---2. Content Use License (Streaming / Platform Use)This license covers use in monetized or public-facing platforms, such as:- Twitch (emotes, badges, overlays)
YouTube (thumbnails, banners, etc.)
- VTuber models, PNGTubers, social media branding (non-merch)
- Patreon or Ko-fi content assets (visuals only, not resale)Allowed:
- Use in monetized streams and content.
- Resize/crop for formatting (non-destructive changes).
- Credit is required when reasonable (e.g., in panels, bios, descriptions).Not allowed:
- Reselling, heavily altering, or claiming the artwork as your own.
- Using the art in AI datasets, NFTs, or blockchain projects.- proper credit is a must (e.g., “Art by @kiwibells_”)

- Printed on products (merch, zines, prints, stickers, apparel).

- Using artwork for business branding and promotional campaigns.Exclusive use may be negotiated for an additional fee.Not allowed:
- Transfer of copyright (unless separately purchased).
